TOPIC

Using IRAC, show how the following common law cases may be analysed in order to understand the principles of law developed in a case and how they are then applied to similar fact cases.

1. Donoghue v Stevenson1930 - (commonly called the ‘snail in the bottle case') - negligence associated with product liability (harmful goods).

2. Hadley v Baxendale 1854 - the issue of foreseeability in the determination of damages in contract law.

3. Shaddock v Parramatta City Council 1982 - negligence associated with misstatement
