Is this good? All societies are grounded by a few things, justice is one of them. Though each country approaches it differently, the differences are sometimes small or significant. The western justice system puts an emphasis on due process, individual rights and decision making, grounded in formal laws while on the opposite pillar the African justice system focuses more on community, reconciliation and restoration. South African is uniquely intertwined with both due to its own complex history of injustice and inequality, where it implements both African and western systems. It is important to understand both systems in order to fully be able to criticise and praise them. This essay argues that a restorative approach, as reflected in African indigenous justice systems, is better suited to South Africa's social and historical context and more effective in building a culture of human rights.
