After cross-examination the defence produced a prior statement by Ms Jamison that the death of Mr Bellamy had not been caused by the motorbike, but by an accidental fall that caused a violent impact with the ground. Under the Evidence Act 1995 NSW and Browne v Dunn is this admissible.
