Problem
A patient has requested to receive an electronic copy of her medical record on a USB drive. The practice front office personnel advised the patient that they would provide the copy on one of the practice's new USB drives and that the copy would be ready in 7 days. The patient objected to the 7 day time period and said that the practice was violating her rights and demanded access to the copies within 24 hours or she would file an Information Blocking complaint against the practice with the ONC. The practice administrator has ask you to advise which authority, HIPAA or the Information Blocking rules, applies to the practice in this situation.
