Problem
Jim is employed by Farmco Ltd as a fertilizer salesman and works with farmers in the rural areas around Auckland and the Waikato region.
Jim has decided on a change of direction in his work and has been offered a job in Wellington selling educational textbooks and intends to take up this job offer. In his new job Jim would be expected to sell textbooks throughout New Zealand.
Farmco do not wish to lose Jim as he is an excellent salesman. There is a term in Jim's contract of employment that states " If the employee leaves the employment of Farmco Ltd the employee shall not work in a sales capacity in any part of the North Island for a period of five years."
