Claire bought a vacuum cleaner for her apartment from a retailer Woosh Ltd. After two months of use, the vacuum cleaner did not operate. No spare parts or repair facilities were available for the vacuum cleaner from the Manufacturer although they promised to supply these facilities to Claire. Woosh Ltd denies that it is liable as it was unaware of the defect in the vacuum cleaner and the retailer sold it to Claire in ‘good faith'.
Advise Claire as to whether Woosh Ltd has breached the Australian Consumer Law 2010 (Cth) and if so, the scope of any remedies they may pursue against them.
