Pretty Diamond Ltd is a limited company (‘the Company’) which engages mainly in the business of designing jewels. Recently, a designer in the Company, Miss Ho, while using a cutting blade, negligently injured the left eye of Miss Beauty, a wealthy customer of the Company. Beauty was badly injured and suffered a permanent loss of eyesight in her left eye. Beauty wanted to sue Miss Ho, estimating that her claim would be about HK$10 million.
Required:
a. Advise Beauty whether she should initiate criminal or civil proceedings by explaining the difference in nature of the two kinds of proceedings.
b. Advise Beauty to which court she should bring her claim and briefly describe the function and duties of this court.
