POLICE REPORT
ACE, Inc. (ACE), incorporated in Maryland and doing business in Prince George's County hires Ben, to deliver furniture to Mary who lives in Baltimore. Ben has a history of alcohol problems and a record of DWI's. Ben stopped at a liquor store and purchased a quart of Jack Daniels. He drunk half the bottle while in route. All of a sudden, a deer ran in front of the truck. Ben hit the deer that became airborne and landed on Carl's car. Carl was driving behind Ben. Carl lost control of his car and struck David who was standing outside of his car. Ernest chased Ben in his truck and forced him off the road where he finally stopped. Ben got out, falling down, and walked over to Ernest. Ben punched Ernest in the face without any warning. Ernest yelled at Ben, What in the hell are you doing, I stopped you because you caused an accident back there! Ben responded, Kiss my ass!, then Ben hit him again breaking Ernest's jaw.
