Accused of burglarizing homes in neighborhood


Assignment task: Your nephew, who lives down the street with his mother, is accused of burglarizing several homes in the neighborhood. You know that he was severely abused by his father during his early childhood and that his mother has struggled to bring him up on her own. Therefore, you know him well and feel sorry for him; you also feel that he can be rehabilitated. Your sister, who is his mother, calls you and asks you to lie to police that he visited your home last Wednesday night. If you don't, she tells you, he will be tried as an adult and face a felony sentence.

a. Is your sister [allegedly] aiding and abetting her son? Why or why not?  If not, is she possibly an accessory after the fact?  What state and/or federal statute(s) may apply?

b. What will you tell your sister, and what will you do?

c. If you are a law enforcement officer and decide to lie for your nephew, how can this affect your career?  Consider Giglio v. United States, 405 U.S. 150 (1972). How does this Supreme Court decision apply to you as a law enforcement officer?
