Discuss in the following sexual harassment case if the company may be held liable or not and why?
"A" is a company which has done all in its power to provide a workplace free from sexual harassment. It developed guidelines for its workers that specifically prohibit sexual harassment. However Jean made a complaint of sexual harassment charging her supervisor had demanded sexual favors. The case was investigated and the supervisor was warned not to continue this conduct, but it happened again. The supervisor has again issued a warning. Finally Jean brought a court action against the supervisor and the company. The company defended on the ground that it had done all its power to rectify the situation.
May the company be held liable? why?
