Under what law? What other facts would be helpful to know in analyzing this situation? Are there any facts that, if different, would help her case? How about if you were defending Lundsford (an agent of the corporation), what would your argument be? Is there any authority to help his case?

b) Edgar Schmoover was a truck driver at the grocery chain Piggly-Wiggly. He was also a transvestite - he liked to dress as a woman. When his supervisor (Mr. Porkins) found out about his cross-dressing, Schmoover was fired. Is Piggly-Wiggly in violation of the law? What other facts would be helpful to know in analyzing this situation? Are there any facts that, if different, would help his case? How about if you were defending Mr. Porkins (an agent of the corporation), what would your argument be? Is there any authority to help his case?

c) Oliver Cloothsoff was a principal at a private Christian school in Greenville, South Carolina. However, it turns out that Mr. Cloothsoff was also a nudist (i.e. he liked to walk around without any clothes on). Cloothsoff's motto was, "This is how God made me, so I'm fine with my birthday suit. Happy birthday to me and my beliefs." While Mr. Cloothsoff was always fully clothed on school property and in public, he was almost always attending nudist retreats and made it known he walked around inside his home completely in the buff. When school superintendent Bertha Butter hears about this, she fires Cloothsoff immediately. Was the termination illegal? From what aspect would you attack this situation if you were defending Cloothsoff? How about if you were defending the school/Butter? What other facts would be helpful to know in analyzing this situation? Are there any facts that, if different, would help his case? What about if this was a public school (non-private and non-Christian)? Would that change your analysis?

d) The Lillian Verner Boutique in Raleigh, North Carolina, would not permit Andy Dick to apply for a job as a salesperson. It only hired women to work in sales because fittings and alterations took place in the dressing room or immediately outside. The customers were buying expensive clothes and (naturally) were demanding a male-free dressing area. Has the Lillian Verner Boutique violated Title VII? What would its defense be? How about if the facts were changed so that Andy Dick was actually a woman (Andrea Dick) and also an open lesbian? And what if the store then decided to not permit her to apply for a job as a salesperson? Does the analysis change? What about if there were documented surveys stating that business would go down if a lesbian were to be working the sales floor at this particular boutique?
