There are certain, limited reasons why an annulment would be granted instead of a divorce. What is the difference between the two, and why would it matter to Ashley, as it was granted in the case below? In preparing the Complaint, you need to state the reason. Is Dave's change or acknowledgment of sexual preference enough?
Dave Johnson, 36, and Ashley, 33, married in October 2002. They live in West Virginia in an apartment owned by Dave. They do not have any children. Dave is an investment consultant, and Ashley works as a counselor in a high school. In August 2004, Dave starts his own firm with his friend John. Dave tells Ashley that he needs to spend time away from home during the setting-up phase, as he needs to create business plans and meet prospective clients.
In November 2004, after two years of marriage Dave tells Ashley that he is not in love with her anymore. He has realized that he is a homosexual and in love with his friend, John. Ashley wants the marriage annulled. Prepare a complaint for annulment on behalf of Ashley.
