Assignment:

The text for this course is Legal Aspects of Health Care Administration, 12th Edition, by George D. Pozgar (ISBN-13: 978-1-284-06592-3). Authorized Consent Priority in Washington

Review the Washington law on informed consent priority found at RCW 7.70.065

Washington defines an incompetent person as any person who is incompetent by reason of mental illness, developmental disability, senility, habitual drunkenness, excessive use of drugs, or other mental incapacity, of either managing his or her property or caring for himself or herself, or both, or deemed incapacitated when the superior court determines the individual has a significant risk of personal harm based upon a demonstrated inability to adequately provide for nutrition, health, housing, or physical safety or is at significant risk of financial harm based upon a demonstrated inability to adequately manage property or financial affairs or if he or she is under the age of majority (18 years)

Note that Washington law specifies that, "[a] determination of incapacity is a legal [and] not a medical decision, based upon a demonstration of management insufficiencies over time in the area of person or estate. Age, eccentricity, poverty, or medical diagnosis alone shall not be sufficient to justify a finding of incapacity."

After reviewing consent of your text, discuss the Washington priorities in the above link, specifically

Why should a priority be given to an appointed guardian over a power of attorney?

See (1)(c). Wouldn't a valid power of attorney executed by the patient (who's now deemed incompetent) be more likely to know the patient's wishes?

What would happen if the healthcare decision in a group is not unanimous? (hint: look at (1)(b)(ii)

See (2). How is the priority list different for children?

Do the sections in (1) and (2) seem to contradict each other? Why or why not?

You are to post your answer and reply to at least one other post. Your reply should consist of a substantive response to a posting's point ("I agree" or "that's a great point", for example, would not be substantive responses). Your score will consist of your complete answers to the points above plus your responses.
