You are required to prepare and submit an investigative report on contractual issues
and dispute resolution of a project provided to you with the following:
? Case study project (3 pages)
? Exhibit 1 - 4
PART A CONTRACTUAL ISSUES (max. 1,000 words)Your discussion should include the following:
? Identify and describe key contractual issues/problems contributing to the failure of construction project.
? Discuss Project Engineer?s responsibilities and contractual duties in regards to the construction dispute.
? Suggest remedies for breach of contract in terms of damages and performance.
PART B DISPUTE RESOLUTION (max. 1,000 words)
Your discussion should include the following:
? Identify and describe contractual means of avoiding disputes with regards to the construction failure.
? Discuss the pre-action steps (what to prepare as a Project Engineer) when disputes arise e.g. initiating a claim and defending a claim.
? Propose one (1) alternative dispute resolution method and describe in detail of the procedure in regards of settling disagreement of the construction project.
