The client Jane arrives with her parents Sue and Bob, and tells you the following story. Jane and Jim have been married for four years, but Jane recently found out that her husband Jim was having an affair. Jane confronted Jim and he admitted he was having an affair with a redhead named Berniece and that he had recently purchased several expensive jewelry items for Berniece . Jane and Jim recently bought a new home and Sue and Bob gifted Jane $10,000.00 for the downpayment. Sue and Bob want their downpayment money back from Jim. Jane wants Berniece held responsible for alienation of affection and wants the jewelry back because it was purchased with funds belonging partially to her. Jane and Jim have two children, Zoe and Zack, and Jane wants sole custody of both children. She believes that Jim’s employer Billy is paying him under the table and he is actually earning a great deal more than he claims, which would mean his child support amount would go up based upon his provable income amount.
