Problem
Assuming that on May 1, 2022, the provincial government passed legislation requiring all businesses to require their employees to retire at age 50. The motivating factor behind this legislation is in response to the high unemployment rate amongst young workers. It is the provincial government's position that such legislation will open up jobs for younger workers and promote economic stability. A group of employees over the age of 50 have rallied together to argue that their equality rights under section 15 of the Charter have been violated and that such legislation is of no force and effect, as it is discriminatory in nature based on age. A copy of Section 15 of the Charter is attached as Schedule "A". Write a report on the appropriate test and analysis on what the Supreme Court of Canada must go through in determining if the legislation should be upheld.
