The public duty doctrine has been characterized as duty to all but duty to no one. This raises interesting questions in regards to how to proceed when errors occur in the public sector. To illustrate, Josie wants to open a coffee shop and finds an empty lot that is for sale. She then consults with City Planning Department and is informed that the land is in an area zoned for commercial uses. Josie proceeds to buy the land and build the coffee shop, all the time conscientiously complying with local ordinances and regulations and cooperating with City inspectors. The day before the opening of the coffee shop, Josie is sued by the local neighborhood association as the land is actually zoned for residential purposes. Josie had proceeded on erroneous information provided by the City, so how should the matter be resolved?
