Our founding fathers adopted (or, more correctly, retained) the English common law after the American Revolution. However, we have consistently refused to adopt the so-called English Plan for the payment of legal fees. The English Plan requires the losing party to pay the plaintiff’s and the defendant’s attorney fees (as well as court costs). Presently, losers in the United States always pay court costs and their own attorney fees (unless otherwise agreed by contract), but do not pay the attorney fees of their opponents. Some observers strongly recommend we adopt the English Plan. Do you agree?
