A deli employee was pouring cleaning chemicals into a container for daily cleaning purposes. Some of the chemicals splashed up from the bottom of the bucket into the employee's eyes, causing a chemical burn. After an initial doctor's visit showed only minor injury, the employee was cleared to return to work and a claim was filed with Local Labor Union, where the deli's worker was a registered member. Several weeks later, the employee experienced complications from her injury and was unable to perform her duties because of blurry vision, light sensitivity and decreased depth perception. The doctor determined the employee had burned her cornea, and she was immediately put on disability Explain the following:

I. Has the employee got the right to claim compensation under the workmen compensation Act 1923? How would you regard the concept of being careful or reckless under the given circumstances?
