I. The Hon. Marc Rosenberg believes "the prevention of wrongful convictions [is] the essential measure of credibility and integrity of the criminal justice system." How does he think the Charter has helped to improve Canada's record on that measure?
II. In R. v. Ipeelee, the Supreme Court stated that failing to consider the constrained circumstances of some Indigenous offenders "would violate the fundamental principle of sentencing - that the sentence must be proportionate to the gravity of the offence and the degree of responsibility of the offender." Do you agree with this statement? Why or why not?
