Daniel Gawenda was injured when he fell from one of these ladders. He sued Werner, alleging that Werner’s failure to build more rigid rear rails into the stepladder constituted negligent design. Gawenda offered no evidence of a stepladder that used more rigid rear rails than Werner’s, nor did his expert present evidence describing the feasibility of alternative designs. How should the court rule on Werner’s negligence claim?
