We will be discussing independent contractors and how to determine the difference between an employee and an independent contractor. One of the things that you can look to is the employer's tax liability. Typically tax liability is determined by the employee's employment status. When an employer is classified as an employee it is the responsibility of the employer to pay state and federal unemployment taxes, social security tax and worker's compensation/disability to a State Insurance Fund. On the other hand when an employee is classified as an independent contractor, the employer is not responsible for those taxes.
