Port Security of the maritime organizations has never been under so much pressure until the Nation found itself struggling on a long road of recovery from the aftermath of the 9/11 tragedy. The transformation and improvement of safety and security measures across the Nations ports maybe at the highest level of protection but are still susceptible for risk of terrorist infiltration or disasters. Port facilities face a physical challenge of mitigating the granting of access control to port facilities without impeding commercial operations, international trade, and other important private and government port establishments. They must be cognitive of who can access entry to the port or what is coming in at any given time. There must be 360 degrees well-defined security implementation to ensure all activities are detected, assessed, and tracked continuously to keep everything and everyone safe.

The SMART Port Security legislation was enacted in addition to the Maritime Security Act (MTSA) and the SAFE Port Act. Smart Port Security Act is another additional layer of security which emphasizes on managing risk approaches concerning commerce coming from international port communities. It was introduced under Department of Homeland Security (DHS), to expand the partnership with Federal, State and local law enforcement agencies, as well as appropriate international entities, in order to enhance the Nation's maritime security, implement risk based-methodology to secure the global supply chain, and find cost savings. (SMART Port Security Legislation, 2012). Our international neighboring trade communities are equally as important as our local homeland ports in regards to the exchange of commercial trades.

Similar to SMART Port Security Act, SAFE Port Act of 2006 is another step taken to improve the maritime security of ports across the Nation. This Act sets requirements to improve communications, between our own ports and international ports to strengthen security at their ports. The United States maritime ports security depends on the security of the foreign ports organizations as well in order to detect and deter threats. SAFE Port Act works in a conjunction network with SMART Port Security Act in a way where one covers our ports and the other focuses on foreign trade partners.

Third additional act was the Small Vessel Security Strategy. It was enacted for the intention of addressing the issue of small vessels. Because of their potential threats of carrying water borne IEDs at a high rate of speed and low profiles, small vessels can cause major risks to our port security. We all remember the attack on USS Cole while it was docked in Yemen. This caused another eye opener at port security. We not only face the issue or terror threats but drugs, human smuggling as well as illegal aliens. Small Vessel Security Strategy is another port security method put forth to extend and harden marine security of ports and coastal waters.

1. The Smart Port Security Act.

The Smart Port Security Act or H. R. 4251 is an amendment, or addition to the Safe Port Act of 2006. The Smart Port Act looks to help secure supply chains by cross utilizing and sharing of information from the Department of Homeland Security with state and local law enforcement agencies to help ensure U.S. Maritime ports are secure. It is thought that this collaboration will not only increase security but also reduce costs as well. The Smart Port Act looks to further secure foreign ports before containers reach U.S. shores. The Smart Port Act looks to further the Customs Trade Partnership Against Terrorism or C-TPAT. The act also looks to recognize other countries security programs. Encompassed under the Smart Port Act is also the TWIC reform or Transportation Worker Identification Credentials, which helps better screen workers at the ports.

2. Safe Port Act.

The Safe Port Act of 2006 or GAO - 08 - 860; is a continuation of the Maritime Transportation Security Act of 2002. The Safe Port Act sought to improve a wide range of security measures already put forth in the MTSA. Under the Safe Port Act, the Container Security Initiative, and Customs - Trade Partnership Against Terrorism C-T PAT was a collaboration between customs and border protection to set forth the security needs of individual ports. The Safe Port Act also sought to restructure wages and schedules for the TWIC. The Safe Port Act also required large-volume containers entering U.S. ports to be scanned for radioactive materials by the last day of 2007. The Safe Port Act also called for more data to be put forth to CBP to help target cargo containers for inspection.

3. Small Vessel Security Strategy.

With the Small Vessel Security Strategy, the Department of Homeland Security sought to reduce the risk of small vessels that might try to smuggle WMDs or terrorists into the United States. The Small Vessel Security Strategy also sought to reduce the risk of small vessels being used as weapon platforms to launch a waterborne improvised explosive device or WBIED. The program sought to enhance maritime security of our ports with a layered approach. The program also saw to develop partnerships inside the small vessels community to help both the public and private sector to understand and be aware of port security risks. Small Vessel Security Strategy seeks to enhance technology in the pretense it's able to detect intent, and where necessary intercept small vessels that pose security threats to our ports. The program also sought to cross utilize international, federal, state, and local as well as the private sector, as a layered approach to securing our ports.
