Instructions - Administer the legal obligations of a building or construction contractor

Metharom Construction (MC) plans to become a leading provider of housing construction and renovation services in the South-East Melbourne area The company's overall strategy will be based on a continuing improvement process of setting objectives, measuring results, and providing feedback to facilitate further growth and progress. They have been involved in large scale construction for 3 years and are now branching out to residential housing.

During this unit, you will need to take on the role of an administration manager Your responsibilities are to lodge payments from clients, ensure compliance with legislative requirements, reconcile departmental finances, accounts payable, assist in resolving financial disputes, prepare pricing of subcontractors, analyse expenses, and provide supporting documentation for financial records, financial analysis.

Assessment 1 Ensure our business is a registered organization.

In order for Metharom's registration to be secured, you will need to ensure that your company has a director who is a registered building practitioner within the appropriate classification/s. Your new CEO needs to renew his registration as it was suspended for more than three years.

To do this, you will need to refer to appendix A to assist you with the following tasks:
a. Completing the registration renewal form
b. Providing a justification about why there was a license suspension (in the form)
c. As a builder/building company cannot be registered without the appropriate insurances, you will also need to identify and explain a minimum of three types of insurance that the company should have, via an explanatory memorandum.
(Ensure to cover insurances for personnel, property and project works)
Your completed form is to be submitted to your assessor.

Assessment 2: Understanding recruitment Process (Maximum of 1000 words)
Two new personnel have been hired for the upcoming projects

A) You are required to select the relevant industrial award for each new employee

B) Determine contracts of employment for both
• Write a contract for Electrician using the right template. Your contract should include but not be limited to the following:
• Information that complies with the Equal Opportunity Act 2010
• Information from the relevant award, including wages and entitlements
• Superannuation entitlements

C) Include policies / procedures for employment termination, redundancy and dispute resolution in contracts.

Assessment 3 Demonstrate understanding of OHS requirements (maximum of 800 words)

A) Identify and list the relevant OHS and welfare Act provisions for this project (refer to the plans)

B) Based on this list develop policies and procedures to cover each of the following:

a. Gaining approval/permits for work to commence

b. Noise abatement and working hours

c. Rights and responsibilities of workers with reference to the workers compensation Act

This assessment should contain no more than 800 words.

Assessment 4: plan an employee return to work via a role play.

A. Write a policy/procedure on rehabilitation arrangements for employees returning from injury or illness.

The policy must include explanation of how the following can be implemented:
- Co-operation with rehabilitation agents
- Light work duties
- Normal duties under short working hours
- Suitable alternative duties
B. (Role play): For this task, your trainer will play the part of an independent safety consultant who specializes in the area of manual handling. You will need to meet with the consultant to facilitate an employee's return to work after a workplace injury (refer to appendix C for additional information).

With the consultant, you will need to discuss the following:

a. Return to work arrangements, such as lighter duties or adjusted work tasks

b. A return to work plan (using the template in appendix C), which is to be presented to the employee for discussion at a later date
You will need to provide your return to work plan to your trainer for assessment at the end of the meeting.

Assessment 5: Comply with taxation legislation.

Prepare a quarterly BAS statement for the ATO on behalf of Metharom Construction, using the information that has been provided in the appendices. Your data for the statement should be presented using the template provided in appendix D.

Your statement will need to include GST labels, such as the total GST sales, GST free sales, and capital purchases (G10).

Assessment 6: Observe fair trading practice

A new home was completed two months ago. The owners, Mr. and Mrs. Holmwood, have complained about a crack that has developed in the living room wall due to a plaster defect or defective concrete. The clients have already moved into the house, and therefore you will need to consider their amenities.

a. Complete the Builder's Rectification form provided (Appendix E). The section A has been filled by home owner. You are required to complete Section B (builder's response) in accordance with the agreed contract.

b. Draft an email to the client that contains: Metharom's apologies for the situation, how the work will be rectified, and how the client's amenity has been considered.

c. You are provided with invoice for the materials purchased for the rectification work, (appendix F). You are required to check the accuracy of the invoice and communicate to the supplier via email if any errors.

Your submission for this assessment should contain no more than 400 words.

Assessment 7: Comply with environmental legislation. (maximum of 750 words)

a. You are required to undertake research on renewable materials available which can be used in place of non renewable materials and low energy materials instead of high energy (list references)

b. Based on the information you gather, write a report for stakeholders on your findings

c. Write a policy on how Metharom will ensure compliance with environmental protection legislation ensuring you include the processes followed at Metharom (include reference to relevant act)

This report must have an introduction, body and conclusion. It may contain a maximum of 750 words.
