The invoice merely sets out the name and the price of the tyres. Later, Adam discovers that these tyres are not safe for off-road work and claims that he is the victim of a breach of contract. Is Adam correct?

(A) No, as there was no express undertaking by Bruce that the tyres would be safe for off-road work.
(B) No, because Bruce is a supplier of tyres and he just sold Adam a set of tyres suitable for on and off-road use.
(C) Yes, Adam is correct as there was an implied term that the tyres should be suitable for off-road driving, and Bruce as a regular seller implied they were suitable.
(D) No, because apart from Adam just saying to Bruce he needs tyres for his fourwheel drive he should have double-checked them before leaving the tyre supplier.
