Bad hiring decision in the private sector

Question 1. How would you define a "bad hiring decision" in the private sector? To what degree do you think staffing managers should be held liable for their decisions? Why? As an HR professional, how can you avoid adverse situations occurring relative to the staffing process? Please provide examples.

Question 2. What actions should be taken concerning disciplining and/or discharging employees in the private sector? How do you, as an HR Manager, know which employee actions require disciplinary action? Please provide examples of employer actions that have been appropriate. How about employer actions that have backfired? What has been the role of case law (court cases) in defining disciplinary actions in organizations? Bring in specific examples.

Question 3. Discuss one or two employment laws (municipal, state and/or federal) and/or court cases that relate to one of the following benefits--workers' compensation, Social Security, jury duty leave, voting leave, blood donor leave, retirement plans, vacations, flexible spending accounts, stock ownership plans, and/or 401(k) plans.

Question 4. Is it time for our nation to take a different approach with labor unions? For example, would our private-sector organizations be better off with government-run labor unions? Or, are there other approaches/changes you have read about that merit further consideration? For example, are there approaches taken in other countries that we might be able to apply in the U.S.? What changes need to be made? Do you have other ideas on this?
