As discussed in class, a crime involves public “social harm” which is conduct that, if proven, will incur the moral condemnation of the community.
In your opinion, how should a law-making body, such as a state legislature, or the U.S. Congress, go about determining the types of behaviors that should be considered worthy of the moral condemnation that will support a behavior being classified as “criminal”? Explain your answer and reasoning.
