Write a paper about someone entering into a contract to buy a car. The person in question has frequent admissions to various mental institutions, but he has long intervals of lucidity between recurring mental problems. During a lucid interval he entered into a contract to purchase a vehicle, but now he wants to avoid the contract on grounds of incompetence. Can he void the contract? And what contract theory of law applies to this?
I believe he can not void this contract as he was in an interval of lucidity at the time which means he had contractural capacity. But my question is what contract theory of law does this fall under? My textbook does not list contract theories of law :-/ That part of the paper is 60 points and I have been looking all night for the answer. Please help. Due today. Thank you.
