Scernario:
2 friends out enjoying a nice on the town. On the way home they get into an accident and the passenger dies. However, the driver was not at fault and the person that hit them had suspended license.
The family of the decreased friend decides not to press charges. The states picks up the case and presses charges on the friend that was driving, Vehicular homicide.
