This part of the paper will require students think about their ethical issue and how to fix it. Your goal here shouldn't necessarily be to eliminate whatever unethical behavior you are writing about; in many cases this will be impossible and/or completely impractical. What this part of the paper should demonstrate is that students recognize that policy design is related to ethical issues in criminal justice, that "bad" policies can have a significant effect on this relationship and that "good" policy design can go a long way in alleviating ethical abuses. Students have some freedom of choice here as they do in the first section of this paper.
You may design a completely original policy or you may take an existing policy and explore how it can be improved and what effects that will have on ethical issues. Whichever you choose you must be able to cite research that provides evidence for your choices. Because of this need for evidence, students will be required to cite at least SIX "scholarly" sources for this paper. Scholarly sources include journal articles, government or think tank* reports and books written by scholars on the subject at hand.
*Some think tanks are illegitimate. Examples of good ones are: Urban Institute, Rand Corp., ABT Associates. Please run the source by me if you are citing a think tank and are not sure if it a legitimate think tank or a partisan organization motivated/funded by ideology and not social science.
THIS PART OF THE PAPER WILL BE SUBMITTED AS DRAFT 2
As noted on the Course Schedule in the Syllabus, Draft 2 is due on November 28th. To complete this section of the paper, refer to the class materials on policy design and policy making (see Welsh and Harris readings and also the Reddington and Bonham readings as well).
This part of the paper should include:
1. Goals and objectives of your policy
2. The design of your policy
o Who is the target population?
o Who is the responsible authority?
o What are the provisions needed to effectively implement this policy?
o What are the procedures needed to effectively implement this policy?
3. Discussion of your policy choices
o Why was this the best route among the alternatives? Will this policy achieve its intended goals?
At minimum for the draft, students should hand in a well-annotated outline of this part of the paper. The best course of action to take would be to treat this draft as if it were the final version of this part of the paper. A good goal to aim for with the draft is about full pages long in outline format, 4 to 5 pages in fully written out format.
Once you have made clear what your policy is, you need to justify your choices with scholarly research. Part of this course demonstrates that just because a policy is in place does not mean it is a "good" or effective policy. This can be for a variety of reasons, from the nature of policy making, to poor choices in policy design, to unforeseen applications of discretion. Therefore, students will take this section of the paper to explain why their policy will be more effective than what currently exists and will do so by citing scholarly evidence.
The evidence for this section is included in your SIX scholarly sources for this paper. The Pollock text will count as one scholarly source for this paper, as will Locked In or Newjack. The best papers will also draw in material from throughout the course. So, there will be at minimum 7 citations total for your paper since you'll need to cite the criminological theory you apply.
