Scenario:
Alpha Kavanagh, a student at UTM, is under arrest by police throughout a pacific march he was participating in and for which prior authorisations have been obtained from the appropriate authorities. He wishes to know whether his right to personal liberty has been breached and whether he can seek compensation if such is the case.
Throughout his detention, he was detained in an extremely small cell, with very little ventilation and which wasn’t lighted at all. These conditions have influenced his health and wishes to know whether he can seek redress under section 7 of our Constitution.
