Question 1:

a) According to Wade, Administrative Law is the Law relating to the control of the governmental power. Describe how far the above statement is true in controlling the government in India.

b) Constitutional Law is concerned with the organization and functions of Government at rest whilst Administrative Law is concerned with those organizational and such functions in motion. Describe the distinctions between the two.

Question 2: The doctrine of Separation of Powers in the strict sense is undesirable and impracticable and, thus, it is not completely accepted in any country- Do you agree? Give your reasons.

Question 3: A Quesin-judicial decision is nearer the administrative decision in terms of its discretionary element and closer the judicial decision in terms of procedure and objectivity of its end product. Describe.

Question 4: Describe the factors which are responsible for the rapid growth of delegated regulation in India.

Question 5: Even though there in no specific bar in the Constitution of India against the delegation of Legislative Power by the Legislature to the Executive, it is now well settled that necessary functions can’t be delegated by the Legislature to the Executive. Describe the impermissible delegation in the Administrative Law.

Question 6: Describe the grounds for judicial control of administrative discretionary powers.

Question 7: The rules of natural justice were placed so high that it was declared that ‘no human laws are of any validity, if contrary to this’. Describe the above with reference to the affect in the Administrative Law.
